• Attempt to hack, reverse engineer, or disrupt the platform
• Submit false or misleading health information
• Impersonate any person or entity
• Transmit viruses, malware, or malicious code
• Use automated tools to access or scrape the platform
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RELAY ARC IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RELAY ARC, ITS OWNERS, OPERATORS, AFFILIATES, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF LIFE, PERSONAL INJURY, DELAYED EMERGENCY RESPONSE, MISSED MEDICATION REMINDERS, DATA LOSS, LOSS OF PROFITS, OR ANY OTHER DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THIS PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE PLATFORM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $0.
You agree to defend, indemnify, and hold harmless Relay Arc and its owners, operators, affiliates, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any inaccurate health or personal information you provide.
You are solely responsible for the accuracy of all health information you enter. We are not liable for any consequences arising from inaccurate, incomplete, or misleading information you provide.
AI-generated summaries and responses are automated and may be inaccurate. Do not make medical decisions based solely on AI-generated content. We are not liable for any harm arising from reliance on AI-generated content.
We do not guarantee uninterrupted access to the platform. We may suspend or terminate the platform at any time without notice. We are not liable for any consequences of service unavailability.
We reserve the right to suspend or terminate your account at any time, for any reason, without notice or liability.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Relay Arc operates, without regard to conflict of law provisions.
Any disputes arising from these Terms or your use of the platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration rather than litigation, to the maximum extent permitted by law.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Relay Arc regarding the platform.
We reserve the right to modify these Terms at any time. Your continued use of the platform following any changes constitutes your acceptance of the new Terms.
